General terms and conditions for Brooklyn Fitboxing

Special deals are not cumulative, nor can they be applied on top of discounts already granted.

1. General Information

The following purchase conditions apply to the purchase of Brooklyn Fitboxing training sessions at Brooklyn Fitboxing Clubs, (hereinafter, “the Club” or “the Clubs”), and by individual customers of Brooklyn Fitboxing, (hereinafter, “the Fitboxers”).

The Club certifies that it is currently authorized to conduct Brooklyn Fitboxing training sessions, expedited by Brooklyn Fitboxing International, S.L. or an entity authorized by Brooklyn Fitboxing International, SL. It also certifies that these sessions are conducted in compliance with the requirements of quality control services established by Brooklyn Fitboxing International, S.L. Brooklyn Fitboxing International, S.L., is a company incorporated under Spanish law, registered in the Commercial Registry of Madrid, BORME-A-2014-81-28, page M-19888, located at Calle Isabel Colbrand, 8 - 4 Derecha, 28050, Madrid, Spain. The tax identification number for Brooklyn Fitboxing International, SL. is B-86989068.

1.1 These Purchase Conditions are valid from 12/23/2024. Brooklyn Fitboxing reserves the right to unilaterally modify these General Conditions at any time. All modifications to these General Terms and Conditions will be published online and will be made known via our APP and/or by email to the address you provided to Brooklyn Fitboxing when purchasing your Trial Session.

1.2 Purchase Conditions apply to Brooklyn Fitboxing training sessions acquired through any of the following options:

1. Purchase of a Trial Session
2. Purchase of Training Sessions
3. Enrollment as a Brooklyn Fitboxing Member

2. Purchase of a trial session

2.1 On the website www.brooklynfitboxing.com, trial training sessions can be purchased at reduced prices and with the free gift of gloves and hand wraps in order to facilitate the initial testing of the BROOKLYN FITBOXING method for those trying us for the first time. In the event that said Trial Session expires, neither the training session nor the gift will be available, unless the expiration is justified by force majeure or is the result of a company breach.

2.2 Therefore, the Trial Session is exclusively directed towards new Fitboxers who are trying out Brooklyn Fitboxing for the first time.

2.3 New customers cannot combine the Trial Session with other kinds of discounts acquired through platforms such as Groupon, Letsbonus, etc.

2.4 To participate in a Brooklyn Fitboxing activity, it is necessary to be older than 14 years old. In order to purchase a Trial Session, the purchaser must be of legal age (18 years) or an emancipated minor.

2.5 When clicking the "Buy" button, you will acquire the Trial Session and receive a confirmation email with your purchase receipt and instructions for using your Trial Session. Brooklyn Fitboxing reserves the right to refuse your request. Only one Trial Session is available per person.

2.6 The Fitboxer hereby agrees to not provide false information, including names, addresses, and/or contact or payment details; not initiate any illegal activity in connection with the purchase or use of the Trial Session; and neither facilitate nor allow any third party to do so.

2.7. The debit or credit card data facilitated during the process of purchasing a Trial Session or any other Brooklyn Fitboxing order will be securely managed with PCI security levels by the company Stripe.com, Adyen.com, or Uniteller.ru.

Data is neither registered nor stored in any server in the Club, nor any Brooklyn Fitboxing International S.L. server.

2.8 The following conditions are set when purchasing the Trial Session.

1. The Trial Session can be purchased only once.
2. The Trial Session can only be redeemed at the Club for which the purchase was made.
3. The Trial Session is valid for one person only and is non-transferable; and
4. You should follow the instructions provided in the purchase confirmation email. The redeem conditions are established in item 2.9 of the present contract.

If you do not receive your purchase confirmation email, we recommend that you check your spam folder. If the message has still not been received after checking your spam, please contact help@brooklynfitboxing.com.

2.9 To redeem the Trial Session, it must be booked through the APP before the indicated expiration date. If you do not redeem your session by booking it within the period listed above, it will expire automatically. Once expired, the session can no longer be used and the Fitboxer will not be able to request a refund, unless justified by force majeure or as the result of a company breach.

2.10 In the event that the Trial Session includes a gift of equipment such as Gloves and Hand Wraps, these will be available to the customer at the Club on the first Trial Session day once the reservation has been made and after the Fitboxer shows the confirmation email received after purchasing the Trial Session. Please note that it is recommended you arrive at least 15 minutes prior to your session in order to redeem your gift and receive instructions on how to carry out your training session safely.

3. Purchase of Training Sessions

3.1 Fitboxers can purchase individual Training Sessions from the APP in the Session Package section. The sessions purchased may be used to reserve Brooklyn Fitboxing training sessions. The total session balance will appear with the corresponding expiration date in the APP.

3.2 Purchased Training Sessions may only be used at the Club for which they were purchased, with the exception of those Training Sessions that are used with Global Pass. In those cases, Global Pass conditions apply (clause 5).

3.3 To participate in a BROOKLYN activity, it is necessary to be older than 14 years old. Training Sessions can only be purchased by a person of legal age (18 years) or by an emancipated minor.

3.4 When clicking the "Buy" button, the Fitboxer will see an increase in their Training Sessions balance. Brooklyn Fitboxing reserves the right to refuse your request.

3.5 The Training Sessions have different expiration dates depending on the option purchased. In all instances, expiration dates are calculated considering that a month has 31 days and the beginning of the validity period is set as the purchase date.

Nonetheless, if a reserved class is correctly cancelled, as per that established in point 9.5, said class may be reclaimed during its validity period. If your reservation is made during the validity period, but the session has expired at the time of cancellation, said session can no longer be recovered even if it is canceled more than two hours in advance.

3.6 Purchased Training Sessions may not be converted into money, except for special circumstances of force majeure, such as the permanent closure of the Club.

3.7 The Club agrees to reimburse the money for purchases that cannot be used due to the permanent closure of a Brooklyn Fitboxing activity. The Club is solely responsible for said reimbursement, exempting Brooklyn Fitboxing International headquarters from any liability in this regard.

3.8 The Fitboxer may obtain Free Training Sessions from the Club. For example, when previously reserved training sessions are cancelled, the Fitboxer will receive Training Sessions that can only be used for booking sessions within the same Club.

4. Wallet

The following terms and conditions of use will apply to the Wallet.

4.1 Use. Our Wallet can only be used for purchasing certain products and/or services via the APP. Purchases will be charged to the balance in the Wallet. Any Wallet balance remaining after a purchase will still be available in the brooklynfitboxing.com account belonging to the customer. Brooklyn Fitboxing International, S.L. may provide the Wallet’s owner with information on the status of the balance contained in their account. Fixboxers can check their available balance in the “Wallet” section of the Brooklyn Fitboxing application, available for download through Google Play and the App Store.

4.2 Limitations. Any balance reflected in the Wallet will always be available and will not have any type of expiration date. The amount reflected in the balance cannot be exchanged for the purchase of products and/or services anywhere other than the APP, unless this is otherwise provided for in these terms and conditions. You may not resell, transfer for a price, use for unauthorized commercial purposes, and/or redeem your balance in cash. No undrawn balance existing in a Brooklyn Fitboxing International account may be transferred to any other Brooklyn Fitboxing International account.

4.3 Fraud. Brooklyn Fitboxing Internacional S.L. has the right to close the customer's account and charge an alternative payment method as a result of the use and/or redemption of any amount that had been fraudulently obtained to make purchases with Brooklyn Fitboxing.

4.4 Liability. Brooklyn Fitboxing International S.L is the depositary of the money that is in the Wallet belonging to each Fitboxer and, therefore, responsible for said money.

4.5 General Terms and Conditions. In all cases, the Conditions of Use and Sale of Brooklyn Fitboxing International will apply. Each time you top up your Wallet or make full or partial use of the balance contained therein, you accept the application of these terms and conditions for the Wallet. Brooklyn Fitboxing Internacional reserves the right to request additional verification of the Fitboxer’s identity, account ownership, and/or to ask the Fitboxer to provide an additional payment instrument before being able to apply a Wallet balance to a purchase. We likewise reserve the right to modify these terms and conditions at any time at our discretion. These terms and conditions will be applied in each case to the maximum extent provided for by law.

4.6 Restrictions and prohibited activities with the Brooklyn Fitboxing Wallet.

Below are the restrictions related to the use of the Brooklyn Fitboxing Wallet. If a Fitboxer participates in these activities, Brooklyn Fitboxing may prevent them from claiming or making use of their Wallet’s balance, or we may take additional measures on their account without the Fitboxer having the right to a refund.

It is prohibited to do the following:

• Sell or exchange a product or service for cash or for any other means of payment or prepayment.
• Gift or receive money in your Wallet as payment for products or services outside Brooklyn Fitboxing. Any entity or person that is not Brooklyn Fitboxing and asks for payment by means of your Wallet’s balance on behalf of Brooklyn Fitboxing International or third parties (as a payment method for products or services) may be a scam.
• Transfer your Wallet’s balance to another account.
• Redeem a Wallet’s balance in an account if you are not the intended recipient. An example of being an intended recipient is if you receive money on your Wallet as a gift. You are not the intended recipient if you have fraudulently deceived the cardholder into adding money to the Wallet (even if they do so voluntarily at the time of the transfer).
• Use the Wallet and Wallet’s balance for any illegal or unauthorized purposes.

The above list of prohibited activities is not intended to be a complete or exhaustive list of all prohibited activities. It is strictly forbidden to engage in any fraudulent activity that, at the sole discretion of Brooklyn Fitboxing, disturbs or is harmful to our Fitboxers, our reputation, our goodwill, our business, and/or our operations. Engaging in prohibited activities when using your Wallet and the balance contained therein is a violation of the General Terms and Conditions set by Brooklyn Fitboxing and may result in us taking action against you—including, but not limited to, preventing you from claiming or redeeming your Wallet’s balance, revoking your Wallet’s balance, and/or closing your account in accordance with our Wallet Terms and Conditions of Use.

5. Booking Global Pass Session

5.1 Fitboxers can book sessions at any Brooklyn Fitboxing Club in the world by using the Global Pass service in the Brooklyn Fitboxing APP.

5.2 By pressing the "Confirm" button, 1 session will be subtracted from the number of sessions available for booking and the financial amount that this session reservation entails in a Club other than your own will be deducted from your Wallet.

5.3 If, once a session has been booked, the Fitboxer decides to cancel it and does so correctly (as established in point 9.5) that session may be recovered during the validity period thereof and the amount paid for the Global Pass reservation will be refunded to the Fitboxer's Wallet.

5.4 Under no circumstances will any refund of the amount charged be made to the Fitboxer's Wallet if the reservation has not been canceled correctly, as established in point 9.5.

5.5 Some Plans may give away Global Pass benefits, and in this case the abovementioned considerations apply.

6. Enrolling as a Brooklyn Fitboxing club member (monthly fee)

6.1 A Fitboxer can choose to train at Brooklyn Fitboxing under a reduced-price Training Session scheme by committing to the automatic monthly renewal of a defined number of Sessions every 4 weeks, choosing from the available options as preferred. These Fitboxers will be called Member Fitboxers.

6.2 Service and fees: The payment of the monthly fee entitles the Member Fitboxer to a reduced price per Session. On the date of registration, the Registration Fee will be paid, as well as the first Monthly Payment; the subsequent monthly fees will be calculated based on this initial date.

Registration and monthly fee prices will be indicated prior to purchase at each Club and in the APP. Prices may vary among Clubs.

Fees will be visible and accessible for all Member Fitboxers in the Club’s fee charts and on the APP, and they may be updated by management for new contracts and/or renewals.

Payments can be made with a credit card. If a card is used, all subsequent amounts will be automatically charged to your card every 4 weeks. For example, if you registered as a Member Fitboxer on a Tuesday, the first day of the month, the next fee will be charged on the fourth Tuesday, the 29th in this example. It is not possible to pay only partial periods.

Alternative payments methods can be agreed upon through prior consultation at help@brooklynfitboxing.com.

In the event that the Fitboxer wants to unsubscribe from the plan before the first 12 weeks have elapsed and there is still a fee to be paid, the Fitboxer will have to make their desire to unsubscribe known in writing at their Club and pay a penalty equal to the amount of one plan payment installment. Said payment will allow the customer to unsubscribe on the next billing date, provided at least 2 weeks’ notice have been given.

Cancellations and changes in the contracted services must be communicated within 2 calendar weeks before the end of the contracted and subscribed period, by filling in the cancellation document which can be accessed by clicking HERE.

The calculation of the 2 weeks will begin from the day following the change or cancellation notification, which must have been formalized in writing, and the fourteenth day may be the same as the day the subscription ends. Unless the Fitboxer makes known their desire to cancel 2 calendar weeks prior to the cancellation date, the contractual conditions will be extended automatically every 4 weeks.

The Member Fitboxer may change Clubs during the twelve-week commitment period without resetting their subscription time.

The sessions purchased can be used both for regular BROOKLYN FITBOXING training sessions and for special sessions; for example, the "Technical Sessions,“ with these having a cost of two regular training sessions that are deducted from the balance of sessions available at the time of booking. There may be special sessions that may have different prices; details will be available at your Club.

6.3 Training Sessions obtained through gifts from the Club can be used for 6 calendar weeks after the last period paid for before cancellation as a Member Fitboxer at the club.

Training Sessions obtained from the Fitboxer Membership plan can likewise be used up to 6 weeks after the last period paid for before cancellation as a Club member.

6.4 Non-payment:

In the event of an outstanding payment, the Club may contact the Fitboxer to notify of the situation, it will retry the charge and, in the event that payment is still unavailable and a second fee becomes outstanding, the Fitboxer will be unsubscribed from the Club; all this notwithstanding there be justified force majeure causes.

The Club reserves the right to legal actions to claim amounts due for the contractual period and any other default payments. Outstanding amounts may be requested of the Fitboxer as stipulated by law, and the Club may delegate the collection of amounts due to a specialized company. In the case of non-payment, the Club may request the payment of any incurred recovery costs.

7. Right of discontinuance (and exceptions), refunds and problems

7.1 The Fitboxer has the right to withdraw from any of their purchases within 14 calendar days following the moment of purchase (the "Withdrawal Period”), and this is in application of Royal Legislative Decree 1/2007, of November 16, approving the Consolidated Text of the Law for the Defense of Consumers and Users and other complementary laws (TRLDCU) — in particular Articles 3, 72, and 103 are applicable.

A Training/Trial Session reservation by a Fitboxer implies that the contract’s execution has begun, with the prior express consent of the consumer and user and with the consumer and user’s acknowledgement that they are aware that, once the contract has been fully executed by the company, they will have lost their right to withdraw.

The contract is understood to be fully executed by the company when the Member Fitboxer has booked a trial session or their first training session under their recurring plan—or when individual training sessions are booked.

The recurring plan will be renewed automatically as established in clause 6.2, and the right to withdraw will not apply to automatically renewed plans.

7.2 If you wish to desist from a purchase, you must do so in person at the Center or by contacting help@brooklynfitboxing.com.

7.3 If the Fitboxer desists from the purchase as stipulated in this paragraph, the Club will reimburse all payments made as part of the purchase within 14 calendar days from the day the Fitboxer informed of their intent to desist.

7.4 Unless the Fitboxer expressly informs the Club of the contrary in advance, all refunds will be made using the same means as the original payment. If the original means of payment has been canceled, expired, or changed in any way, the Fitboxer must inform the Club immediately. In the event you fail to do so and the refund is made to the original means of payment, you may need to notify your bank or payment service provider for reimbursement. The Club will not provide more than one refund.

8. Service standards and accountability

8.1 The Club agrees to:

• Apply reasonable care and skill to fulfill its obligations under these General Terms and Conditions.
• That training sessions are of satisfactory quality and suitable for their purpose, and do not violate the requirements of professional diligence and good faith underlying the services provided.
• The Club is not responsible for any breach of an obligation under these General Terms and Conditions when obstructed or impeded in carrying out its duties for any reason beyond its reasonable control.

9. Booking Policy

9.1 Brooklyn Fitboxing training sessions are used upon prior reservation. Said sessions will only be enjoyed by Fitboxers who have previously booked them.

9.2 Brooklyn Fitboxing Trainers will roll call at the start of each session to verify that such booking has been made properly. The Club may restrict access to training sessions for Fitboxers who have not previously registered.

9.3 All reservations are to be made only through the reservation system from the APP.

9.4. Fitboxers can book the session with a maximum of 1 or 2 weeks in advance, depending on the Brooklyn Fitboxing Club and up to the beginning of the session, as per availability.

9.5. Sessions can be cancelled as of the time of booking confirmation and up to 2 hours before their start time. If cancelled correctly, the session will not be deemed as having been used. After said limit, a session may be cancelled, although it will be deemed as used and, thus, no monies corresponding to said reservation will be reimbursed.

9.6. Any sessions that have been properly canceled within the prescribed period may be taken during their validity period, provided there is availability. The sessions that have not been used within the 6-week timeframe will be deemed as used.

9.7. Reservations under the “invite a friend" scheme. The Fitboxer who is making the reservation and inviting their friend(s) will be charged for their own reservation and that of their invited friend(s), as well as any Global Pass addons that may apply. In the event that the friend organizing the reservation cancels it, it will be canceled for all the guests, applying the considerations listed in section 9 of the Reservation Policy, as well as section 5 of Global Pass. In the event that the organizing Member Fitboxer does not show up for the Session but also does not cancel it, their invited guests will be able to enjoy it. In order to be invited by a Member Fitboxer, the guest must have at least purchased a Trial Session.

10. Liability

10.1 The Fitboxer certifies that they have been informed by the Club that Brooklyn Fitboxing training sessions are a high-intensity physical activity that requires a healthy physical state.

10.2. Any recommendations of any type provided by the Club’s staff do not, in any way, constitute medical advice. When in doubt, the Fitboxer should always consult a specialist. In the event that the Club’s team identifies a potential health risk, they could require a medical certificate authorizing physical exercise in the gym, having the option to refuse admission.

10.3. The Club declines any liability arising from the member's misuse of the facilities or sports equipment as well as their participation in a sporting activity without proper physical conditions or a doctor’s supervision, unless there is any deceit or negligence on the Club’s behalf.

11. Miscellaneous

11.1 If the Fitboxer breaches these General Terms and Conditions and the Club has not initiated any legal action against them, this does not mean that the Club has waived its rights and compensation relating to non-compliance. The Club may still take action or exercise its rights and seek compensation for these acts, doing so within the legally applicable timeframes. Likewise, the Club may seek compensation for any other situation where the Fitboxer has breached their obligations under these General Terms and Conditions.

11.2 Unless otherwise stated in these General Terms and Conditions, notifications between the parties shall be in writing and delivered by email at help@brooklynfitboxing.com. The Club will use the email address provided by the Fitboxer when purchasing the Trial Session to send out all types of notices.

11.3 If any provision of these General Terms and Conditions is held invalid or unenforceable, the validity and enforceability of the remaining provisions of these General Terms and Conditions shall not be affected. Such invalid or unenforceable provisions will be replaced by a valid, enforceable provision that is as close as possible to the economic effect referred to in the invalid or unenforceable provision.

This circumstance will only be valid if the new provision favors the consumer more than the absence of it.

11.4 These General Terms and Conditions are governed and interpreted under the laws in force in the country where the Club is located. Any dispute will fall under jurisdiction courts of the country where the Center is located.

12. Data Protection

In accordance with Organic Law of Data Protection and Guarantee of Digital Rights, as well as with the General Data Protection Regulations, all DATA sent by the Fitboxer through www.brooklynfitboxing.com shall be treated by BROOKLYN FITBOXING INTERNATIONAL, S.L. in an automated manner, and will be incorporated into the Treatment Activities Registrar with the objective of offering and managing the Products and Services of BROOKLYN FITBOXING INTERNATIONAL, S.L.

The controller for the Treatment Activities Registrar is the limited liability company BROOKLYN FITBOXING INTERNATIONAL, S.L., with legal address at Calle Isabel Colbrand, 8 - 4 Derecha, 28050, Madrid. Email: protecciondatos@brooklynfitboxing.com.

DATA owners have, at all times, the right of access, rectification, erasure, objection, portability, and limitation in the treatment of their data, as per the terms included in the data protection legislation.

Personal data belonging to the Fitboxer will be treated in compliance with the contractual relationship maintained with Brooklyn Fitboxing as well as to inform them of Brooklyn Fitboxing activities and promotions.

The legal basis for the treatment of the Fitboxer’s data is the fulfilment of the contractual relationship maintained between them and Brooklyn Fitboxing, as well as the legitimate interest for the dissemination of information we deem of interest to the Fitboxer. In this regard, it is important to note that you may unsubscribe to commercial mailings at any time by following the instructions included in the correspondence we send to you.

Your data will be treated as long as you maintain a contractual relationship with Brooklyn Fitboxing and with regard to the use of your data for the communication of information pertaining to our activity, unless you exercise your rights of limitation and objection to treatment for this purpose.

Your data will not be released to third parties, except for your workout centers, which shall be considered data controllers, and in cases of regulatory compliance on behalf of Brooklyn Fitboxing.

Data pertaining to your image may be used by Brooklyn Fitboxing with the objective of promoting the training centers. To the extent possible, Brooklyn Fitboxing will inform you when a photograph or video is used for promotional purposes.

As per the present clause, it will only be necessary to contact BROOKLYN FITBOXING INTERNATIONAL, S.L. via email at protecciondatos@brooklynfitboxing.com, or through postal mail at the business address Calle Isabel Colbrand, 8 - 4 Derecha, 28050, Madrid. BROOKLYN FITBOXING INTERNATIONAL, S.L. guarantees it has taken all necessary safety measures in its facilities, systems, servers, and files in order to avoid unauthorized DATA access.
